This End User Licence Agreement ("Agreement") is a contract between you and Nuancebit GmbH for the use of the Age of Towers app. Apple is not a party to this Agreement, although it has certain rights under it as described in section 15.

By downloading or using Age of Towers ("the App") you accept this Agreement. If you do not accept it, do not use the App.

2. Licence granted

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, which are incorporated into this Agreement by reference. This licence is for your own private, non-commercial use.

Please note that the campaign unlock described in section 4 is not enabled for Family Sharing. It is tied to the Apple Account that made the purchase.

3. What you may not do

You may not redistribute, rent, lease, sublicense or sell the App; modify its data files in order to bypass paid content; or circumvent the purchase mechanism. You may not reverse engineer, decompile or disassemble the App, except to the extent that such a restriction is prohibited by mandatory law — in particular the decompilation rights granted for interoperability purposes under §§ 69d and 69e UrhG.

4. The in-app purchase

Chapter 1 (six levels) is free. A single non-consumable in-app purchase, Full Campaign Unlock (com.ageoftowers.unlock.lifetime), unlocks Chapters 2 to 4 — the remaining fifteen levels — together with the Bronze, Iron and Medieval ages and the Cannon, Magic and Ballista towers.

The total price is €4.99 including 19% German VAT for the German App Store. No further costs arise — there are no delivery, shipping or other charges, since the content is unlocked within the App.

Because Apple acts as the seller and accounts for VAT in the buyer's country, the applicable VAT rate — and therefore the final price — differs by storefront, and prices are set per storefront and may change over time. The price shown by the App Store at the moment of purchase is the authoritative one. This is a one-time purchase. There is no subscription, no consumable currency, no loot box and no advertising.

You can restore a previous purchase at any time using Restore Purchases in the App's settings, using the same Apple Account you bought it with.

5. Refunds and your right of withdrawal

Apple is the seller of record for the in-app purchase. All payments and refunds are handled by Apple under the Apple Media Services Terms and Conditions, and we are not able to issue refunds ourselves. Refund requests go to reportaproblem.apple.com.

Consumers in the EU have a statutory 14-day right of withdrawal for digital content. This right lapses once performance has begun with your express consent and your acknowledgement that you thereby lose it (§ 356(5) BGB) — which is what happens when the unlock is delivered immediately upon purchase. Because the contract of sale is concluded with Apple rather than with us, Apple's withdrawal and refund process applies.

6. Maintenance and support

We alone are responsible for providing any maintenance and support for the App. You can reach us via the support page. We aim to respond within five business days. We do not guarantee uninterrupted availability or any particular update schedule.

7. Apple has no support obligation

Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

8. Warranty

Your statutory rights as a consumer under German law, in particular the provisions on digital products in §§ 327 ff. BGB, remain fully unaffected and are not excluded or limited by this Agreement. Beyond those mandatory rights, and to the extent permitted by law, the App is provided "as is".

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.

9. Product claims

We, and not Apple, are responsible for addressing any claims made by you or by any third party in relation to the App or your possession and use of it, including but not limited to product liability claims, any claim that the App fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

10. Intellectual property claims

In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, and not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.

11. Ownership and third-party notices

All rights in the App — including its code, artwork, audio and the name Age of Towers — belong to Nuancebit GmbH. All assets are original works or are properly licensed for this use.

12. Third-party terms

The App uses no third-party services, SDKs or frameworks beyond Apple's own operating-system frameworks, so there are no additional third-party terms for you to comply with. Your use of the App must nevertheless comply with the Apple Media Services Terms and Conditions.

13. Legal compliance and export control

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You further agree to comply with all applicable export control laws, including those of the United States and the European Union.

14. Content rating

Age of Towers depicts mild, infrequent fantasy violence in a stylised setting. It contains no blood or gore, no realistic violence, no profanity, no gambling or simulated gambling, no advertising, no user-generated content and no chat or social features.

15. Apple as third-party beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it.

16. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).

For simple negligence we are liable only where a material contractual obligation has been breached — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

17. Term and termination

This licence runs until terminated. It ends automatically if you breach its terms, and you may end it at any time by deleting the App. Your purchase entitlement remains associated with your Apple Account in accordance with Apple's terms.

18. Governing law and jurisdiction

This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country in which you are habitually resident (Art. 6 Rome I Regulation). Where you are a merchant, the place of jurisdiction is Göttingen.

19. Consumer dispute resolution

Wir sind nicht bereit oder verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

(We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.)

20. Severability and changes

If any provision of this Agreement is or becomes invalid, the validity of the remaining provisions is unaffected. We may update this Agreement for future versions of the App; the version and effective date at the top of this page always identify the current text.
